Applicability of Labour Laws


  • The Factories Act: The Act is applicable, where 10 or more workers are being employed with the aid of power.

  • Employees Provident Funds Act: This Act is applicable, where 20 or more employees are being worked in organization including Head Office, branches, warehouse, Sales Staff, etc. While calculating total number of employees indirect employees will be counted.

  • Employees State Insurance Act: This Act is applicable, where 20 or more employees are being worked in organization drawing gross salary/ wages equal or less than RS.15,000/- p.m. including Head Office, branches, warehouse, Sales Staff, etc. In case, organization is involved in manufacturing process or it is a factory then this Act will be applicable where 10 persons are employed.

  • Maharashtra Labour Welfare Fund Act: The applicability of this Act is limited in Maharashtra only and it is applicable, where 5 or more employees are being worked in organization including Head Office, branches, warehouse, Sales Staff, etc.

  • The Payment of Gratuity Act: This Act is applicable, where 10 or more employees are being worked in organization including Head Office, branches, warehouse, Sales Staff, etc.

  • The Payment of Bonus Act: This Act is applicable, where 10 or more employees are being worked in organization including Head Office, branches, warehouse, Sales Staff, etc.

  • The Shops and Establishment Act: This Act is applicable to any shop, commercial establishment is notified local area.

  • The Maternity Benefit Act: Where 10 or more persons are working, this Act is applicable.

  • The Employees Compensation Act: This Act is applicable to every employer where ESI Act is not applicable.

  • The Minimum Wages Act: This Act is applicable to every establishment, shop and Factory.

  • The Payment of Wages Act: This Act is applicable to every establishment, shop and Factory.
